Generally, our professional services are offered on a contingency basis and are payable by the employer if an applicant is referred and hired directly or indirectly, by the employer or anyone you would refer the candidate to within twelve months. The fee is also earned in the event the employer refers the candidate to another employer who hires the candidate. The fee shall be paid by the employer, regardless of the claim of or obligation to any other party regarding a placement fee for the candidate. This fee is based upon 25% of the employee's first year's anticipated gross compensation. Information provided to you by the candidate and other sources, directly or through us, has not been independently verified by Searchco, LLC.

This fee is based upon the payment of a contingency upon the candidate reaching a starting date of employment. Our fee is based upon a percentage of the employee's estimated first year's total earnings. For positions paying commissions, bonuses, or other incentives, with or without salary, estimated first year earnings would include a reasonable estimate of such compensation. Estimated first year earnings are not subject to an increase or reduction after the placement.

Should any individual placed by Searchco, LLC or leave his/her position, or be terminated for cause within the first one hundred eighty (180) days that employment began, the fee charged the employer shall be refunded or the candidate replaced, provided the invoice is paid in full in accordance with our schedule of service charges within the first sixty (60) days of the candidate’s starting date. One Hundred Eighty (180) calendar days after the date the applicant has begun work, the placement shall be deemed a permanent placement and no refund shall be due the employer if employment should cease for any reason.

The title of the initial position to be filled is_________________________. The estimated first year compensation is estimated to be $____________________(Dollar Amount).  This agreement may be amended to include additional and subsequent job orders or search assignments under the same terms as this agreement (under contingency terms) that are transmitted or communicated to Searchco, LLC by client verbally, email, fax, or regular mail.  This agreement shall be valid for two years from the date it is executed, unless terminated in writing by either party.

This agreement entered into and governed by the laws of the State of Michigan.  If any candidate already presented by Searchco, LLC later enters into an employment or service relationship within one year of presentation to the Client, or at the time of termination of this contract later enters into a service or employment relationship, either as a (Individual, Independent Contractor, Consultant, or Corp. to Corp.) with the Client within one year of the date of presentation, then the balance of the service charge will be due and payable when the candidate starts.  Any dispute arising out of this agreement shall be resolved through binding arbitration. 

It will be necessary during this period to keep lines of communication open. We will be communicating regularly to update you as to our efforts and will expect timely feedback from those within your organization during this process.  Please date and sign below and return to us, by mail or fax, as an indication that you agree with the above mentioned.  Thanks and we will be in touch with you as soon as we receive this authorization to proceed.
